Privacy & Personal Data Policy

1.Introduction
(PP001) As a customer of Trading App Store LLC’s (the “Store”, which term is more broadly defined above in (00^) herein ) Informational Services) , in addition to the term of Use/ Terms and Conditions (as set forth above on this web-site the “ Site” ) to which you are bound, are also subject to the terms of this Privacy and Personal Data Policy (the” Policy”) , which is subject to revisions and amendments at the sole discretion of the Store.
(PP001A) You acknowledge the receipt of good and valuable consideration by the Store in exchange for your agreement to accept the Policy, as part of the Store’s Terms and Conditions. We urge you and your advisors, including legal counsel, to carefully review the Policy, and contact us at support@tradingapps.ai for questions and concerns.
(PP001B) NOTE: IF you are a citizen of any country where you or your financial accounts are covered by the General Data Protection Regulation (“GDPR”), the Store will not accept Your Data at this point in time. Please check back with us for future updates.
(PP002) If you do not agree with the Policy, in whole or in part, please do not share any of Your Data with the Store.
(PP003) In your use of the Informational Services. at the outset and from time to time, you will be providing the Store with accurate personal data, which may include financial information, and which also may include communications between yourself (or any person acting on your behalf) and the Store via email, text, or other digital communication platforms that may exist on the date hereof or become available in the future. (“Your Data”). In accepting receipt of Your Data, it will only be used by the Store for the purpose of enabling you to have access to, and personal use of Informational Services.
(PP004) The Store has taken what it, in good faith, believes are commercially reasonable technical and organizational measures to ensure the protection of Your Data. However, all information, including Your Data, is subject to risks (including hacking or alteration of Your Data) that could occur via internet-based data transmissions which are outside the Store’s control, and which may have security gaps that may be exploited by third parties. Absolute protection of Your Data is not guaranteed.
(PP005) Set forth below are the specifics of how and why Your Data is received, gathered, collected, processed, transmitted, shared, and used, as well as the general outline of the controls and choices you have when and how you choose to share Your Data.
2.About The Policy
(PP006) The Policy applies to all Informational Services currently offered or which may be offered in the future, as from time-to-time described in the Site or other Store publication or announcements. and any associated services which are being, or which may be, provided by the Store. You understand and agree that in almost any case, the Informational Services are provided by third parties, and as per Section ** of the Terms and Conditions, the Store has no responsibility for the accuracy of such third-party Informational Services and is not liable in any way for actual, consequential, or punitive damages that could arise from your access or use of such Informational Services. The Policy also applies to communications arising between the Store and you (and your authorized representatives) via mail or other written media, email, text, telephonic or other digital communication platforms that may exist on the date hereof or become available in the future.
(PP007) From time to time, the Store may develop new or offer additional services which are then included in the definition of Information Services. If the introduction of these new or additional services results in any change to the way we collect or process Your Data, we will provide you with more information and additional terms or policies. Unless stated otherwise when we introduce these new or additional services, they will be subject to the Policy.
(PP008) The Policy is intended to ensure that you understand the reasons why Your Data is received, gathered, collected, processed, transmitted, shared, and used, collected, and who it may be shared with; and how the Store seeks to protect the privacy of Your Data.
3.Your Rights
(PP009) Under federal law in the United States, you have the right to limit only: •sharing information about your creditworthiness for affiliates’ everyday business purposes.

State Considerations: The practices described above meet the minimum requirements of United States federal law. You may have other protections under applicable state laws. To the extent these state laws apply, we will comply with them.
(PP010). You have the following rights when submitting Your Data to the Store:
●Right of Access – the right to be informed of and request access to Your Data that has been received and processed ;
●Right to Rectification – the right to request that we amend or update Your Data where it is inaccurate or incomplete;
●Right to Erasure – the right to request the deletion of Your Data (but subject to governmental laws or regulations that require we maintain that information for matters that include Know Your Customer or Anti-money laundering issues, or to address issues of claims or indemnification) ;
●Right to Restrict Processing – the right to request that we temporarily or permanently stop processing some or all of Your Data;
●Right to Data Portability – the right to request Your Data in a structured, commonly used and machine-readable format and the right to transmit Your Data for use in another party’s service; and
●Right not to be subject to Automated Decision-making – the right to not be subject to a decision based solely on automated decision making, including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.
(PP011) Additional Rights under State and Federal Laws and Regulations. It is possible that current or future laws and regulations could provide you with additional privacy and personal data rights. To the fullest extent possible, the Policy is intended to conform and be consistent with these Additional Rights, and the Policy will be interpreted accordingly
4. How does the Store collect Your Data?
(PP012) The Store may collect Your Data in the following ways:
●When you visit our Site – when you visit our Site, we collect certain of Your Data to help increase data protection, data security and ensure an optimal level of protection for Your Data.
●When you register and become a customer for Informational Services – after you have accepted the Terms and Conditions we collect certain of Your Data (such as your email address, birth date, name, mailing address, phone number and payment information) so you can use the Store so you access Informational Services.
We use Shopify’s Customer Accounts to handle client login, and detail information. We are using the internal Shopify merchant processing, so we will technically not have access to any credit card or payment related information.
●Personal data collected that enables us to provide you with additional features/functionality – when you sign up for additional materials from the Store, such as our nightly newsletter or other marketing materials, or contact The Store’s customer service through the Site, or participate in our blog comments, we collect certain personal information about you. You will always have the option to change your mind and withdraw your consent at any time.
●From third parties – we may receive personal data about you and your activity from third parties, including advertisers and partners we work with in order to provide you with the chance to access Informational Services.
2.What personal data do we collect from you? --Personal data collected when you visit our Site
(PP013) General Data
(PP013A) This is the personal data that is collected by us to help optimize your experience when visiting our Site, as well as increase data protection, data security and ensure an optimal level of protection for the data we process.
(PP013B) We collect the following general data when you visit our Site: (1) the browser types and versions used; (2) the operating system used by the accessing system; (3) the website from which an accessing system reaches our Site (so-called referrers); (4) the sub-websites; (5) the date and time of access to the Internet site; (6) an Internet protocol address (IP address); (7) the Internet service provider of the accessing system; and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.
(PP013C) When analyzing this general data, the store does not draw any conclusions about the data subject. Rather, we analyze the anonymously collected data and information statistically and anonymous data of the server log files are stored separately from all personal data provided by a data subject.

(PP014) Personal data collected when you sign up for Informational Services
(PP014A) Account Registration Data
This is the personal data that is provided by you or collected by us to enable you to sign up for and use Informational Services. This includes your first and last name, email address, credit card number, billing address, and other information required to process your payment.
(PP014B) By registering on our Site, the IP address (assigned by the Internet service provider (ISP) and used by the data subject), date and time of registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and if necessary, to make it possible to investigate committed offenses.
(PP014C) Payment Data
We may collect such personal data if you sign up for a Informational Services involving trial or full subscriptions, seminars, tutorials, , or Software (as defined in our Terms and Conditions). The following personal data collected will vary, but will include information such as:
●Name;
●Credit or debit card type, expiration date, and certain digits of your card number;
●Postal code;
●Mobile phone number; and
●Details of your transaction history.
(PP015) Personal data collected that enables us to provide you with additional features and functionality.
(PP015A) This is the personal data that is provided by you to subscribe to our regular or episodic newsletters or video presentations. This includes your name and a valid email address. A confirmation email will be sent to the e-mail address registered by data subject for double opt-in purposes. This confirmation e-mail is used to prove whether the owner of the e-mail address as the data subject is authorized to receive the newsletter.
(PP015B) During the registration for a newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of registration, as well as the date and time of the registration. The collection of this data is necessary to understand the (possible) misuse of the e-mail address of a data subject.
(PP015C) You can unsubscribe from the email at any point in time. You may be contacted via email in the case that the newsletter offer is modified, canceled, or materially changed, or in the event of a change in technical circumstances.
(PP016) Marketing Data
(016A) This personal data is used to enable the Store and our partners/service providers to send you marketing communications either:
●Via email;
●Whilst using Informational Services ; and/or
●Direct from the third party
(016B) You can unsubscribe from the email at any point in time.
(PP017) Contact via Website
(017A) The Site contains information that enables a customer to quickly engage our customer service team via email or a contact form. If a data subject contacts via email or a contact form, we may collect the following information: name, email address and phone number.
(PP018) Blog Comments Data
(018A) The Site may publish a blog ( or similar comment platform) and it is possible that blog will allow for data subjects to leave comments on the blog/comment platform If a data subject willingly leaves a comment, the comment made by the data subject, as well as the date and time of the comment and the data subject’s username are published on the site.
(PP018B) In addition, the IP address assigned by the Internet Service Provider (ISP) to the data subject is also logged.
PP(018C) If a data subject subscribes to the following comments on a blog post, we will collect their email address. An automatic confirmation email to check the double opt-in will be sent to the email. The option to subscribe to comments may be terminated at any time.
(PP019) Why the Store uses Your Data ?
(019A) When you use or interact with the Site, we use a variety of technologies to process the personal data we collect about you for various reasons. We have set out in the table below the reasons why we process your personal data, the associated legal basis we rely upon to legally permit us to process your personal data, and the categories of personal data (identified in Section 5) used for these purposes:

Categories of recipients of the personal data collected or generated through your use of Informational Services.
(PP020A) Publicly available information Certain parts of Your Data will always be publicly available on the Site: your username and the date and time if you leave a comment on a blog post on the Site.
(PP020B) We use technical service providers which may operate the technical infrastructure that we need to provide the Informational Services , in particular providers which host, store, manage and maintain the Site and application, its content and the data we process.
(PP020C) We use technical service providers to help us communicate with you, as described in Section 6 of the Policy.
(PP020D) We use marketing and advertising partners to show you more tailored content, or to help us better understand your use of Informational Services, to provide you with a better experience. We also may share portions of Your Data with certain marketing and advertising partners to send you promotional communications about the Store.
(PP020E) Store Partners
If you access the Site and are using Informational Services through an offer that you received or purchased from a third party, we share portions of Your Data with that third party, such as whether and to what extent you have used the offer, activated a Store account, or actively used any Informational Services.
(PP0120F) Law Enforcement and Data Protection Authorities
We will share your personal data when we in good faith believe it is necessary for us to do so to comply with a legal obligation under applicable law, or respond to valid legal process, such as a search warrant, a court order, or a subpoena.
(PP020G) We also will share your personal data where we in good faith believe that it is necessary for our own, or a third party’s legitimate interest relating to national security, law enforcement, litigation, criminal investigation, protecting the safety of any person, or to prevent death or imminent bodily harm, if we deem that such interest is not overridden by your interests or fundamental rights and freedoms requiring the protection of your personal data.
(PP020H) Purchasers of our business; Joint Venture
(PP020I) We will share your personal data in those cases where we sell or negotiate to sell our business to a buyer or prospective buyer, or to enter into a joint venture with a third party. In this situation, the Store will continue to ensure the confidentiality of Your Data and give you notice before Your Data is transferred or otherwise disclosed to the buyer or becomes subject to a different Privacy Policy.
(PP021) Data retention and deletion
(021A) We keep your personal data only as long as necessary to provide you with Informational Services, and thereafter for such time for legitimate and essential business purposes, such as maintaining the performance of the Site making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal data for as long as you are a user of the Store.
(PP021B) By written request, we will delete or anonymize Your Data so that iit no longer identifies you, unless we are legally allowed or required to maintain certain of Your Data, including situations such as the following:
●If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved,
●Where we are required to retain the Your Data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
●Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
(PP022) Links
We may display advertisements and offers from third parties and other content that links to third-party websites, which could include persons providing access to their websites as part of thee Informational Services you are sourcing from the Site. . We cannot control or be held responsible for third parties’ privacy practices and content. If you click on a third-party advertisement or link, please understand that you are leaving the Site and any personal data you provide will not be covered by the Policy. Please read their privacy policies to find out how they collect and process your personal data.
(PP023) Keeping your personal data safe.
(023A) We are committed to protecting Your Data. We implement appropriate technical and organizational measures to help protect the security of Your Data; however, please note that no system is ever completely secure. We have implemented various policies including pseudonymization, encryption, access and retention policies to guard against unauthorized access and unnecessary retention of Your Data in our systems.
(PP0213B) Your password protects your user account, so we encourage you to use a unique and strong password, limit access to your computer and browser and log out after having used the Site and/or any Informational Services.
(PP024) Cookies
We use cookies from third-party vendors such as Google, Facebook, and Microsoft. Cookies are small pieces of text sent to your browser when you visit a site. They serve a variety of functions, like enabling us to remember certain information you provide to us as you navigate between pages on the Site. We use cookies to authenticate, personalize and secure your account as well as for analyzing performance and analytics.
You may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely used.
(PP025) Children
(PP025A) The Site and Informational Services is not directed to children under the age of 18 years. However, in some countries, stricter age limits may apply under local law. Please see our Terms and Conditions for further details.
(PP025B) We do not knowingly collect personal data from children under 13 years or under the applicable age limit (the “Age Limit”). If you are under the Age Limit, please do not use the Site, and do not provide any personal data to us.
(PP025C)If you are a parent of a child under the Age Limit and become aware that your child has provided personal data to the Store, please contact us at support@tradingapps.ai and you may request exercise of your applicable rights detailed in Section 3 of this Policy.
(PP025D) If we learn that we have collected the personal data of a child under the age of 13 years, we will take reasonable steps to delete the personal data. This may require us to delete the Store’s account for that child.
(PP026) California Online Privacy Protection Act; Nevada; Vermont
(PP026A) CalOPPA is a California state law requiring commercial websites and online services to post a privacy policy. Compliance of the law is required by any company that reaches California consumers. According to CalOPPA, we agree to the following:

●We will add a link of the privacy policy on our home page
●You will be notified of any privacy policy changes on our privacy policy page, through the “updated date” on the top of the page

(PP026B) Residents of Nevada: At any time, you may request to be placed on the Store’s internal do-not-call list. (PP026C) . Residents of Vermont: In accordance with Vermont law, we will not share your financial information with non-affiliates without your consent except as permitted by law. For example, we may share your financial information without your consent in order to service your accounts. We will not share information about your creditworthiness among our affiliates except with your consent or as required or permitted by law.
(PP026) Contacting the Store
We try to respond to all legitimate and verifiable requests within forty-five (45) days. Occasionally it may take us longer than 45 days if your request is particularly complex, you have made several requests or additional information is needed from you to process your request. In this case, we will notify you within the 45-day period and keep you updated. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically. If we cannot comply with your request, we will explain the reasons why we cannot comply. Fees are not usually required. You will usually not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request under these circumstances. Additionally, we are not required to action a request to access your information more than twice in a 12-month period.
(PP027) Changes to this Privacy Policy… We may occasionally make changes to the Policy.
(PP027A) When we make material changes to this Policy, we’ll provide you with prominent notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the Site or by sending you an email. We may notify you in advance. Please, therefore, make sure you read any such notice carefully, as you will be bound by those changes.

(PP028) CAN-SPAM Compliant
(026A) The Store is CAN-SPAM compliant, which allows you to request we stop sending you emails. Our emails contain “unsubscribe” options, which you may use to stop receiving emails from the Store. If you have any issues unsubscribing from our emails, please contact support@tradingapps.ai.
(029) Definitions
(PP030 ) Waiver
Further to the Terms and Conditions, if the Store does not comply with any of the terms of the Policy (unless such breach occurs as a result of a knowing and willful action that is intended to cause you financial or economic or personal harm or loss, and such knowing willfulness and intention is determined by mediation), the Store has no liability to you or any other person for any claim of any kind (including actual, consequential or punitive) and including any claim for actual, potential or consequential economic loss or financial damages or damages/losses based on personal or business reputation or actual or potential business or personal relationships.
